7. Horizontal division

The horizontal division of a building is an act where a property is divided into independent registry properties. Each property that results from the horizontal division has its own cadastral reference and a participation in the community proportional to its surface area. The original property is removed from the property registry and two new records are generated.

STEPS FOR HORIZONTAL DIVISION

The steps to carry out the horizontal division of a property are the following:

  1. Preparation of the horizontal division project
  2. Municipal horizontal division license
  3. Writing horizontal division statement
  4. Property Registry or Cadastre

REQUIREMENTS FOR HORIZONTAL DIVISION

To divide a property into other independent ones, the Horizontal Property Law says that an agreement is needed from all the owners of the community as well as a Horizontal Division Project that is signed by a competent technician (an architect or a surveyor).
